Work permits in the United States: what Form I-765 does and who may qualify.

A work permit can change the daily life of a family, but it is not a stand-alone path that everyone can simply apply for. Employment authorization usually depends on an underlying immigration category, application, or benefit.

Start With the Underlying Case

A work permit is usually the result of another immigration basis.

One of the most common questions immigration lawyers hear is, “Can you get me a work permit?” The question makes sense. An Employment Authorization Document can allow a person to work legally while it remains valid and can make everyday life more stable.

But Form I-765 is not a universal application that creates eligibility by itself. USCIS requires the applicant to identify an employment-authorization category. That category is tied to a separate immigration basis, such as a pending application, an approved benefit, or another classification recognized by law.

That is why our office starts with your immigration history rather than the form. Before anyone tells you to file, the first job is to identify whether a category actually fits your case.

A work permit is not the same thing as immigration status. It authorizes employment for the period and category shown on the document. It does not, by itself, make someone a lawful permanent resident, provide a visa, erase past immigration issues, or authorize international travel.

What an EAD Is

Employment authorization is specific, temporary, and category-based.

USCIS uses Form I-765, Application for Employment Authorization, for eligible applicants requesting employment authorization or an Employment Authorization Document, commonly called an EAD or work permit.

It can authorize employment.

When USCIS grants employment authorization, the EAD provides evidence that the holder may work during the period and under the category shown on the card.

It does not create permanent residence.

An EAD is not a green card and does not make the holder a lawful permanent resident. The underlying immigration case remains a separate legal matter.

It is not a travel document.

A work permit does not itself authorize international travel or guarantee reentry. Travel must be analyzed separately before leaving the United States.

Pending adjustment of status

Certain applicants with a pending Form I-485 may request employment authorization under the adjustment-of-status category.

Pending asylum application

Certain asylum applicants may request employment authorization after the legal requirements for that category are met. Our firm does not use a work-permit filing as a substitute for analyzing the underlying immigration matter.

Employment authorization associated with DACA depends on the current legal status of the program and the individual applicant's circumstances.

Humanitarian

VAWA, U visa, T visa, TPS and other categories

Some humanitarian classifications or pending applications may provide a basis for employment authorization at particular stages. The timing and category must be checked against the current rules.

Renewal Planning

Do not wait until the card expires to ask what happens next.

Renewal rules depend on the category, filing date, and current USCIS policy. The safest approach is to identify the expiration date early, confirm that the underlying basis still exists, and check the current filing rule before relying on continued work authorization.

Employment-authorization extension rules have changed. Do not assume an old rule still protects your work authorization.

Important 2026 renewal point

DHS ended the broad practice of granting the former up-to-540-day automatic EAD extension to many renewal applicants who file Form I-765 on or after October 30, 2025. Some category-specific or law-based extensions can operate differently. Before relying on a receipt notice as proof of continued work authorization, check the rule that applies to your exact category and filing date.

If there is a valid basis to request employment authorization, the I-765 should fit into the larger strategy. If there is not a valid basis, filing a form does not create one.

Can I apply for a work permit if I do not have another immigration case?

Usually, Form I-765 requires an eligible employment-authorization category. The form itself does not create the category. The first question is what underlying immigration basis, if any, applies to your situation.

Is a work permit the same as legal status or a green card?

No. An Employment Authorization Document is evidence of permission to work during the period and under the category shown. It is not a green card and does not itself create permanent immigration status.

What does category C09 mean on an EAD?

C09 is generally associated with applicants who have a pending application for adjustment of status. Eligibility for the I-765 and the underlying I-485 must still be evaluated based on the individual case.

Does filing an I-765 renewal automatically extend my work permit?

Do not assume that it does. DHS changed the automatic-extension rules for many renewal applications filed on or after October 30, 2025. Whether any extension applies depends on the category, filing date, and current law.

Can I travel outside the United States with only an EAD?

An EAD is not a travel document. International travel can affect an immigration case, and the correct travel document and legal consequences should be reviewed before departure.

How long does USCIS take to approve Form I-765?

Processing time varies by category and case. USCIS publishes current processing information, so the timing should be checked for the relevant filing rather than relying on an old estimate or another person's case.
