The notice came. After the waiting and the paperwork, something finally arrived that said approved.

That is worth something, and it is not what most families think it is.

We are going to be very clear about this part, because families make real decisions on it. Job decisions. Housing decisions. Decisions about travel.

What the Approval Actually Did

It established the family relationship, which is the thing USCIS was deciding. The government now accepts that you are who you said you are to each other.

It locked in the priority date, which is your place in line for the categories where a line exists.

That is a real accomplishment and it is the foundation everything else is built on.

What It Did Not Do

This is the part to read twice.

An approved I-130 grants no immigration status. It grants no lawful presence. It is not permission to remain in the country. And it carries no work authorization.

The regulation that lists the categories of people who may work in the United States contains no category based on a pending or approved I-130. There is no line on that list for this.

The authority is INA § 204(b), 8 U.S.C. § 1154(b). USCIS says it on its own page about the form: “Filing and approval of an I-130 is only the first step in helping a relative immigrate to the United States.”

Two things follow from that, and both cost families real money.

One. It does not authorize work. If someone has been waiting on approval before starting a job, the approval did not change that.

Two, and this is the one that changes cases. For a beneficiary who is in the United States without status, approval does not stop unlawful presence from accruing. The clock that was running before is still running.

That second fact is the one that decides whether a case later needs a waiver, and it is why the next step matters more than the approval did.

So What Comes Next

Approval of the petition is not the application for the green card. Those are two different filings, and which one comes next depends on facts about the beneficiary.

If a visa is immediately available, the case moves to the application stage, either inside the United States or at a consulate abroad. Which of those two roads applies is not a preference, and for some people one of them carries real risk.

If the category has a line, the priority date has to be current before that step happens.

And which road applies turns on how the beneficiary entered the country. That is the question we ask first in every one of these cases and it is not one a website should answer for you.

What We Would Tell You Not to Do

Do not start a job on the strength of this notice.

Do not travel on the assumption that approval protects the case.

Do not wait passively for the next thing to arrive. For some families the next step is available right now. For others there is preparation that should be happening during the wait rather than after it.

The Honest Framing

The petition is the door. It is not the destination.

Getting through the door is real and you should feel good about it. What it changed is your paperwork. What it did not change is your status.
