Somebody has probably told you to “file a FOIA.”

Before you pay for one, it is worth knowing exactly what that is, because a lot of people buy it thinking it is one thing and it is another.

A records request is not a case. It is not an application. Nothing gets approved and nothing gets granted.

It produces information. That is the entire product, and it is more valuable than it sounds.

What a Map Is Worth

Nobody plans a long drive without knowing where they are starting from.

That is what this is. The record tells you where you are actually standing, which is different from where you think you are standing, and in this area of law those two things are different more often than they are the same.

And here is the part that makes it worth paying for: the map determines which roads exist.

Broadly, a record points toward one of four things.

One. There is a route that runs from inside the country. The record supports handling the case without leaving.

Two. There is a route that runs through a consulate abroad. A different process, different steps, and a real decision to make about it.

Three. There is a route that requires clearing something first, and what that looks like depends entirely on what the record shows. We are not going to tell you that this road is open to you. Nobody can say that before reading your file.

Four. There is no route right now. That is a real outcome and it happens, and a firm that leaves it off the list is a firm that has decided to sell you something.

The record is what tells you which of those four you are looking at. Not a phone call. Not somebody’s cousin. Not a page like this one.

What It Does Not Do

It does not tell you whether you qualify for anything. Records show what happened. Eligibility is a legal judgment applied to what happened, and those are two different jobs done by two different things.

It does not fix anything. Whatever is in the record was already there. Reading it changes your information, not your history.

It does not come with a promise about contents or timing. Nobody can tell you in advance what will come back or exactly when. The law sets a window measured in working days, not calendar days, and past that window is backlog.

And it is not one request. Depending on what you need, it can be several requests to several different agencies. What USCIS holds and what the immigration court holds are separate files at separate agencies, and one does not include the other: the USCIS file and the immigration court file are two different records.

Why We Sell This First

Because the alternative is worse for you.

The alternative is a firm that takes a retainer, files something, and finds out what is in your record when the government responds. You paid for that discovery either way. The only question is whether you paid before or after a filing that may have been the wrong filing.

There is also a version of this where the record shows something hard. That is not a reason to skip the map: if the record is bad, is it over.

What This Should Change About What You Ask For

If somebody quotes you a price for “a FOIA,” two questions are worth asking before you hand anything over.

Which agencies are you requesting from, and why those?

What happens after it comes back, and is that included?

A person who cannot answer the first one has not thought about your case. A person who cannot answer the second one is selling you a document rather than an answer.
