Your petition is approved. The case is at the National Visa Center. You are gathering documents, and one of them is taking longer than expected.
That is the situation this page is about, because it is the one where families lose cases without ever being told a clock was running.
The Short Answer
Once you are notified that a visa is available, there is one year to apply for it.
If that year passes without the application, the registration is terminated by operation of law. Not flagged. Not warned about. Terminated.
The law is INA § 203(g), 8 U.S.C. § 1153(g), with the procedure at 22 C.F.R. § 42.83.
What “Terminated” Actually Costs
This is the part worth understanding before it matters.
A terminated registration that is not reinstated in time generally means starting over with a new petition. Not resuming. Starting over, with the years that took the first time.
For a family that has already waited through a priority date, that is the most expensive outcome in the entire consular process, and it is reached by doing nothing.
Reinstatement Exists, and It Is Narrower Than People Assume
There is a second window. Within two years of the original notification, the applicant can seek reinstatement.
But it is not automatic and it is not a form. It requires establishing that the failure to apply was due to circumstances beyond the applicant’s control. The regulation gives examples: illness or physical disability that prevented travel, a home government refusing to permit departure, foreign military service.
Read what is not on that list. Waiting on a document. Not understanding the notice. Not receiving mail at an old address. A family emergency that was serious but did not prevent applying.
Forgetting is not a circumstance beyond your control, and that is the honest gap between what families expect and what the rule says.
Two Numbers, and They Are Not the Same Number
One year from notification to apply, or the registration terminates.
Two years from that same original notification to seek reinstatement, on a real showing.
The second clock runs from the original notification, not from the termination. So the reinstatement window is not two additional years. It is one additional year after the first one closes.
The Other One-Year Clock, Because They Get Confused
There is a separate one-year rule that applies after an interview, when a case is refused under section 221(g) and the applicant has to submit something further.
Different trigger, different starting point, same consequence of termination. If someone has told you about a one-year deadline, it is worth knowing which of the two they meant, because the dates are not the same.
What This Should Change About How You Wait
Waiting is not neutral in this process. That is the whole point of this page.
If a document is taking a long time, that is a reason to raise it, not a reason to wait quietly. The problem is almost never that a family did not care. It is that nobody told them the waiting had an end date.
Know the date of your notification. It is the fact everything on this page runs from, and most families cannot find it when asked.
